Disclaimer

1. The following disclaimer applies to all cleaning cloths, cleaning rags or specialty cloths (Rag Products) that are purchased by you from Neplusultra Pty Ltd ACN 103 651 627 trading as Metro Rags & Supplies.

2. You acknowledge that the Rag Products that are offered for sale by us are sourced from third-party contractors and suppliers. Whilst we use our best endeavours to ensure the Rag Products that we offer are free from defect and are of the best possible quality, because the Rag Products that we offer for sale are sourced and packaged by third-parties, we are unable to make any guarantee or warranty in this respect.

3. By proceeding with purchasing a Rag Product, you acknowledge and agree:

(a) the Rag Products that we are offering for sale are sourced from and packaged by third-parties, and we do not have any oversight or ability to exercise quality control with respect to that process;

(b) we make no representation, guarantee or warranty that Rag Products:

(i) will be free from metal, foreign objects or other defects;

(ii) are not a fire hazard;

(iii) do not create static electricity;

(iv) contain any specific ingredients, components or materials, or are made of 100% cotton;

(v) will be of a colour or have an appearance that exactly reflects the colouring or appearance of Rag Products as displayed on any website we operation, or in any advertising content that we create;

(c) we make no representation, warranty or guarantee that Rag Products will be fit for any particular purpose, or will be able to be used to achieve any specific outcome; and

(d) we have made no representations, and you have not relied on any representations, regarding any of the matters identified in 3 (a) – (c), regarding the Rag Products.

4. We may from time to time make information available to you regarding Rag Products and our related products and services. This may include, for example, general information regarding spill responses. All such information is provided on an “as is” basis and must not be relied upon as advice. You acknowledge that your reference to and use of such information is entirely at your own risk. We make no warranty, representation or guarantee that any such information is correct, accurate or up-to-date.

5. Subject to paragraph (6) and to the fullest extent permitted by law, we exclude all liability to any person for all loss or damage (however arising), whether in contract, tort (including negligence), statute, equity or otherwise, that relates to:

(a) your failure to comply with any of the matters referred to in items (2) – (4) of this disclaimer;

(b) your use of website or reliance upon any information that is contained upon our website (or that we otherwise provide generally);

6. Where you are entitled to a statutory guarantee pursuant to the Australian Consumer Law as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), our liability is limited (at our election) to us providing the Rag Products again or the payment of the cost of having the Rag Products supplied again.

Delivery Policy

This policy sets out the delivery of your online purchases.

Where we deliver

We will deliver to most addresses within Australia, but do not deliver to international locations. We require a street address for delivery – unfortunately we cannot deliver to a P.O. Box. Some remote locations cannot be serviced, however Metro Rags & Cleaning Supplies' carrier may be able to deliver to a local depot where you can collect your products.

The locations we can deliver to may change from time-to-time. Please call our Customer Service Centre to find out if we deliver to your location.

How and when we deliver

All deliveries are made 8.30am to 5.00pm Monday to Friday by Metro Rags & Cleaning Supplies's chosen carrier.

During peak periods (Easter or Xmas), the delivery may take up to 14 working days.

Please note that these delivery times are estimates only, and actual delivery times may vary. Large items require extra handling and may take longer to transport.

Items may be delivered to you individually and/or separately by different couriers and transport agencies.

For large items, the courier will attempt to contact you to arrange a delivery time using the contact details provided by you.

We are not responsible for any late delivery or failure to deliver due to circumstances beyond our reasonable control. For certain products, items may be delivered directly to you by Metro Rags & Cleaning Supplies's supplier.

The supplier will contact you shortly before delivery to arrange a suitable delivery time and delivery location (where reasonable) at your address. The supplier will contact you on the day prior to delivery to confirm these details. The supplier will deliver the product to your requested location at your address wherever possible. Please ensure that your requested delivery location is free from obstructions and is otherwise in a clean and tidy state to prevent any delivery delays. At the time of delivery, you will be asked to sign a form to acknowledge that the goods were delivered in good and proper condition. Where you have requested that a representative accept delivery of the goods on your behalf, this delivery acknowledgment will be obtained by the supplier from your representative. Please note that the supplier is under strict instructions to only deliver and obtain delivery confirmation from you personally unless you agree to other arrangements with the supplier.

Cost of delivery

Delivery charges are calculated on a per order basis and according to the weight and size of your order, and your delivery address.

If you would like an estimate of your cost of delivery, put the item into your shopping bag and displayed at the bottom is your estimated delivery charge. You will have the opportunity (based on your entered postcode) to view the finalised delivery charges on your order at the checkout stage before you complete your order and make payment.

Acceptance of delivery

Deliveries must be signed for, and anyone at the delivery address who receives the products shall be presumed by Metro Rags & Cleaning Supplies to be authorised to receive the products.

Unfortunately Metro Rags & Cleaning Supplies and its carriers are unable to provide an estimate of the delivery time. If you are unsure if you will be available at the delivery address during the delivery hours, we recommend nominating a work address or address of a family member who will be present during the delivery hours. In the instance someone is not able to sign for your delivery, Metro Rags & Cleaning Supplies's carrier will leave a card. When delivered by Australia Post you will need to collect your delivery from the closest Post Office. Any other carrier you will need to contact them directly to make alternative delivery arrangements, which may include a re-delivery fee charged by Metro Rags & Cleaning Supplies if re-delivery is required.

Please note that risk for loss or damaged product passes to the customer upon delivery of the product(s) by the courier.

We take all reasonable steps to keep secure any information which we hold about you. Personal information may be stored both electronically on our computer system, and in hard-copy form. Firewalls, 2048 Bit v3 SSL encryption, passwords, anti-virus software and email filters act to protect all our electronic information.

We do not store credit card information, we securely submit credit card information to our bank for processing.
